Acceptance of Terms

By using Size AI, you agree to these Terms of Service. If you don’t agree, please don’t use the app.

In these Terms, “Size AI,” “we,” “us,” and “our” refer to the Size AI service.

Use of Service

Size AI provides AI-powered garment measurement tools. You must:

• Be at least 13 years old
• Use the app lawfully and responsibly
• Not reverse engineer or harm the service
• Not violate others’ intellectual property rights
• Have a compatible device with required hardware capabilities

Your Content

You own the photos and measurements you create. By using Size AI, you grant us permission to:

• Process your images to provide measurements
• Store your data securely
• If — and only if — you opt in to the optional photo-sharing program, use the capture photos you share to train and improve our measurement models, as described in our Privacy Policy. You can withdraw this consent anytime in Settings, which also deletes the photos you previously shared

You represent that you have the right to use any content you upload and that it doesn’t violate any third-party rights.

Subscriptions & Purchases

Size AI offers optional auto-renewing subscriptions and one-time credit packs, billed through your Apple ID:

• Subscriptions renew automatically each billing period unless cancelled at least 24 hours before the current period ends. Manage or cancel anytime in your Apple ID subscription settings
• Plan allowances (such as measurement scans and Photo Studio images) reset each billing period; unused allowances do not roll over
• Credit packs are one-time consumable purchases; their credits are added to your account and consumed as you use the corresponding features
• Prices are shown in the app before purchase. Subscription price changes follow Apple’s notice and consent process
• Payments, refunds, and billing disputes for App Store purchases are handled by Apple under Apple’s terms; we cannot issue App Store refunds directly
• If you subscribed on an earlier plan that is no longer sold, your plan and its allowances continue as shown in your Plan & Usage page
• Promotional allowances (such as referral or creator-code bonuses) are limited-time, non-transferable, and have no cash value

User Conduct

You agree not to:

• Upload content that infringes on intellectual property rights
• Use the service for illegal purposes
• Attempt to gain unauthorized access to our systems
• Interfere with or disrupt the service
• Use automated systems to extract data
• Violate any applicable laws or regulations

Privacy

Your use of Size AI is subject to our Privacy Policy, available at https://sizeai.co/privacy.

Third-Party Services

Size AI uses third-party services for data storage and authentication. These services have their own terms and privacy policies.

Disclaimers

SIZE AI IS PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING:

• MERCHANTABILITY
• FITNESS FOR A PARTICULAR PURPOSE
• ACCURACY OF MEASUREMENTS
• NON-INFRINGEMENT

We don’t guarantee:

• Perfect measurement accuracy
• Uninterrupted service availability
• Suitability for professional or commercial use

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

(a) SIZE AI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, DATA LOSS, OR BUSINESS INTERRUPTION.

(b) OUR TOTAL LIABILITY SHALL NOT EXCEED $100 OR THE AMOUNT PAID BY YOU IN THE PAST 12 MONTHS, WHICHEVER IS GREATER.

(c) THESE LIMITATIONS APPLY REGARDLESS OF THE THEORY OF LIABILITY AND EVEN IF WE’VE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Indemnification

You agree to indemnify, defend, and hold harmless Size AI and its officers, directors, employees, and agents from all claims, damages, losses, and expenses (including legal fees) arising from:

• Your use or misuse of the service
• Your violation of these Terms
• Your violation of any third-party rights
• Content you upload or share

Intellectual Property

Our Rights

• Size AI and its original content, features, and functionality are our property
• Our trademarks and trade dress may not be used without permission

DMCA Compliance

If you believe content infringes your copyright, contact us at legal@sizeai.co with:

• Description of the copyrighted work
• Location of the infringing material
• Your contact information
• Statement of good faith belief
• Statement of accuracy under penalty of perjury

Termination

We may suspend or terminate your access for:

• Violation of these Terms
• Illegal or harmful activity
• At our sole discretion with or without notice

You may stop using the app at any time. Upon termination, your license to use the app ends, but provisions that should survive will remain in effect.

Changes to Terms

We may update these Terms at any time. We’ll notify you of material changes through the app or via email. Continued use after changes means you accept the new terms.

Dispute Resolution

Informal Resolution

You agree to try to resolve disputes informally by contacting support@sizeai.co before pursuing formal action.

Arbitration

Any disputes not resolved informally shall be resolved through binding arbitration under AAA rules. You waive your right to jury trial and class actions.

Exceptions

Small claims court actions and injunctive relief for intellectual property violations are excluded from arbitration.

General Terms

Governing Law

These Terms are governed by the laws of the State of Delaware, USA, excluding its conflict-of-law rules.

Severability

If any part of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.

Entire Agreement

These Terms are the entire agreement between you and Size AI, the owner and operator of Size AI, regarding your use of the Size AI app and services.

Assignment

You may not transfer or assign these Terms or any of your rights under them. Size AI may assign its rights and obligations under these Terms to any affiliate or successor entity.
